The purpose of a K-1 visa is to come to the US to get married. The couple has typically 90 days to get married once the K-1 is approved. There are 3 stages for the K-1 Visa:
- USCIS
- File Form I-129F / K-1 Petition with USCIS
- NVC
- Once USCIS approves the petition, it will be forwarded to the National Visa Center (NVC) for case creation.
- Consulate Interview
- The US Consulate abroad will then schedule an interview. The foreign fiance is typically asked questions about the relationship to ensure that it is a valid visa. If approved, the K-1 will be issued.
The couple must get married within 90 days of entry to the US, or during the I-94 period, whichever is shorter.
The foreign spouse can then file to Adjust Status as the spouse of a U.S. citizen (i.e. file for the Green Card).
